Respondent Criminal Original Petition filed under Section 482 Cr.P.C. to modify the condition imposed by an order dated 23.1.2017 passed in Crl.M.P.No.296 of 2017 on the file of the learned Principal Sessions Judge, Salem, that instead of petitioner shall stay at Villupuram and report and sign before the learned Judicial Magistrate No.I, Villupuram, to Judicial Magistrate No.II, Sankari.
For Petitioner : Mr.R.Ezhilarasan For Respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed to modify the condition imposed on the petitioner in Crl.M.P.No.296 of 2017 dated 23.1.2017 by the learned Principal Sessions Judge, Salem.
2. It is the case of the petitioner that he filed a petition in Crl.M.P.No.296 of 2017 before the learned Principal Sessions Judge, Salem, seeking bail and the learned Judge granted bail to the petitioner on certain conditions. One of the conditions is that the petitioner shall stay at Villupuram and report and sign before the learned Judicial Magistrate No.I, Villupuram, daily twice at 10.00 a.m. and 5.00 p.m., until further orders. Since the petitioner is a daily wage employee, he is unable to comply with the said condition. Hence, seeking modification of the said condition, the petitioner has come up with the present petition.
3. Learned Additional Public Prosecutor has no serious objection to modify the said condition imposed on the petitioner.
4. Considering the facts and circumstances of the case, the condition imposed on the petitioner in Crl.M.P.No.296 of 2017 dated 25.1.2017 by the learned Principal Sessions Judge, Salem, viz., the petitioner shall stay at Villupuram and report and sign before the learned Judicial Magistrate No.I, Villupuram, daily twice at 10.00 a.m. and 5.00 p.m., until further orders, is hereby modified as follows:-
“ The petitioner shall report and sign before the learned Judicial Magistrate No.I, Villupuram, on the first working day of every week at 10.30 a.m., until further orders“ The other conditions shall remain unaltered. The criminal original petition is ordered accordingly.
