This application under Section 482 of Cr.P.C. has been filed by the applicants with the prayer to quash the impugned order dated 22.06.2018 passed by Additional Session Judge Court No.10 in S.T. No.1494 of 2016 (State vs. Rajiv and others) arising out of case crime no.393 of 2016, under section 363, 366 I.P.C. and 16/17 Protection of Children from Sexual Offences Act, P.S.- Thakurdwara, District- Moradabad.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicant has not been able to point out any such illegality, impropriety or incorrectness, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order. The impugned order reflects judicial application of mind. So far as the standard of sufficiency of evidence in the present case is concerned this court does not find any good reason to take different view in the matter and it appears that the evidence produced in the court are sufficient to justify the summoning of the accused. There is no good reason to set-aside the impugned order. The prayer for quashing the impugned proceeding cannot be accepted.
However, in view of the peculiar facts and circumstances of the case, it is directed that in case after surrendering in the court below an application for bail is moved on behalf of the accused within four weeks from today, the same shall be considered and decided in accordance with law.
