Heard Shri Arvind Kumar, learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Additional Chief Standing Counsel for the State- respondents.
The present writ petition has been filed questioning the validity of the impugned notice dated 10.12.2020 issued by the respondent No. 4.
Shri Sanjay Kumar Singh, learned Additional Chief Standing Counsel for the State-respondents has raised two fold objections; firstly the writ petition is liable to be dismissed on the ground that the proceedings are still pending consideration and secondly without final call on the said objection, the shown cause notice cannot be challenged.
Confronted with this situation, learned counsel for the petitioner apprised the Court that due to some unavoidable circumstances, the petitioner was absent as he was behind the bar, once he bailed out, he submitted reply/objection on 15.12.2020 in response to the notice dated 10.12.2020.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of asking the competent authority to take final decision strictly in accordance with law within four weeks from the date of production of a copy of this order.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
