Heard learned counsel for the petitioner; learned Standing Counsel for the respondents 1 to 3; and perused the record.
The petitioner is an Assistant Teacher at Primary Vidyalaya, Chaubepurva, Block Sirsiya, district Shravasti. It appears that in connection with medical leave application, the petitioner submitted certain document in respect of which a complaint was made that the same is bogus. To enquire about the veracity/authenticity of the said document, the Chief Medical Superintendent, Bangala Joint District Hospital, Hathras wrote a letter to Dr D.S. Rathore, National President, Hindu Mahasangh, U.P., Lucknow for a direction upon the petitioner to appear at the hospital concerned with all her papers for the purposes of verification of the documents. Copy of that letter has also been forwarded to the District Basic Education Officer, Shravasti. It is this letter which has been challenged by the petitioner by means of this petition.
As the respondents are only seeking verification of a document which is stated to have been used by the petitioner for claiming medical leave, we do not find any good reason to entertain this petition, at this stage. In case, any adverse action is taken against the petitioner, it shall always be open for the petitioner to challenge the said action by taking recourse to appropriate legal remedy as may be advised.
Subject to above, the petition is dismissed. Order Date :- 20.9.2021.
