Heard learned counsel for the applicant as well as learned AGA for the State of U.P and perused the material available on record.
Applicant claims his implication false by counting various reasons, prime being that the applicant happens to be the deed writer and he has got no connection with either side of the sale deed say the vendor or the vendee. In usual course of his profession/work, he writes title deeds and sale deeds and that merely cannot count for his involvement and complicity with the parties for causing wrongful loss to the informant. Whatever offence has been committed, has been committed by the other co-accused, who have played active role in causing wrongful loss to the informant. There is no possibility of absconding or misusing the liberty of bail if the applicant is admitted to bail. The applicant has no criminal history and is languishing in jail since 13.11.2018.
Learned AGA has opposed prayer for bail. However, he has not disputed the aforesaid facts.
Without entering into merit of the case but considering the facts and circumstances of the case, nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with witness or apprehension of threat to the complainant and prima facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail.
Accordingly, bail application is allowed.
Let the applicant - Satyaveer Singh involved in Case Crime No. 2151 of 2018, under Sections - 467, 468, 471 I.P.C., Police Station - Karhal, District - Mainpuri be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
It is made clear that the advantage of this bail shall not go to the other co- accused, who are allegedly involved in the commission of the crime and the case of the applicant is distinguishable from them.
