Heard Mr. Parvesh Kumar Pandey, learned counsel for petitioner, learned Standing Counsel for the State-respondents and perused the record.
The instant writ petition under Article 226 of the Constitution of India, has been filed by the petitioner, who is the Ex-Gram Pradhan of village Nera Khadar, for the following relief:
"(i) Issue a writ, order or direction in the nature of mandamus commanding and directing to the respondent No.4/Tehsildar, Tehsil Mahawan, District Mathura to decide the Case No.00678 of 2021 (Computerized Case No. T202101500500678) Gram Panchayat vs Sitaram, under section 67 of the U.P. Revenue Code, 2006, related to Arazi No. 1600 area 0.0100 hectare, Arazi No. 1602 area 0.0650 hectare, Arazi No. 1603 area 0.0030 hectare and Arazi No. 1604 area 0.0140 hectare village Nera Khadar, tehsil Mahawan, district Mathura, expeditiously within a certain stipulated to time as fixed by this Hon'ble Court.
(ii) Issue a writ, order or direction in the nature of mandamus commanding and directing to the respondents not to raise any construction in the above-disputed land in question herein till the disposal of the above mentioned case pending before the Tehsildar, Tehsil Mahawan, district Mathura."
The record reflects that the proceedings for eviction under section 67 of U.P. Revenue Code, 2006 was initiated by the Gaon Sabha in respect of the land of plot being Arazi No. 1600 area 0.0100 hectare, Arazi No. 1602 area 0.0650 hectare, Arazi No. 1603 area 0.0030 hectare and Arazi No. 1604 area 0.0140 hectare, situated in village Nera Khadar, tehsil Mahawan, district Mathura, against respondent No. 6, which remained pending till date. The petitioner has neither made party in the proceedings nor has any locus to maintain the present writ petition. No such prayer as prayed by the petitioner can be granted at the instance of the person, who is stranger to the proceedings.
After the aforesaid order has been passed, learned counsel for the petitioner submits that he does not want to press this writ petition.
The prayer is accepted.
Accordingly, the writ petition is dismissed as not pressed.
