Grievance is that without undertaking any demarcation over petitioner's plot/land the authorities are proposing to construct a Panchayat Bhawan. According to petitioner his construction and Sahan is over plot no.131, which is recorded in his name while adjoining plot no.132 is recorded as Naveen Parti. It is contended that in the garb of raising construction on plot no.132 the authorities are encroaching upon petitioner's land over plot no.131.
The averment made in the writ petition reveals that there is a dispute with regard to demarcation over plot no.131 vis-a-vis plot no.132. Such issues can be got resolved in proceedings under section 24 of the U.P. Revenue Code, 2006.
In the event petitioner makes an application before the concerned Sub Divisional Magistrate, he shall ensure that appropriate demarcation exercise is undertaken, after due notice to Gaon Sabha, at the earliest, preferably within a period of two months from the date of presentation of a certified copy of this order. Any further construction on the disputed land shall await conclusion of proceedings under section 24 of the Code.
Writ petition is, accordingly, disposed off.
