Heard Mr. Sheetla Sahai Srivastava, learned counsel for applicants and learned AGA for State.
This application under Section 482 Cr.P.C. has been filed challenging order dated 27.1.2020 passed by Special Judge (SC/ST Act) Agra, in Complaint Case No.107 of 2018, (Chhavi Ram Vs. Satya Prakash Tyagi & others), under Sections 344, 323, 504 & 506 IPC & Sections 3(1)(da) & (dh) P.S. Basoni, District Agra whereby non-bailable warrants have been issued against applicants.
At the very outset, learned AGA has raised preliminary objection by submitting that non-bailable warrants were issued against applicants vide order dated 27.1.2020 and inspite of fact that period of more than 18 months have rolled by from the date of order dated 27.1.2020, applicants have not yet appeared before court below. Consequently, proceedings of above mentioned case have remained held up on account of non- cooperation of applicants. On aforesaid premise, present applicants do not deserve any indulgence of this court.
When confronted with aforesaid, learned counsel for applicants could not overcome the submissions urged by learned A.G.A.
In view of above, no occasion arises before this Court to interfere in present application.
Accordingly, present application fails and is hereby dismissed.
