The petitioners herein are defendants in Original Suit No.761 of 2018 and are aggrieved by the ex-parte interim injunction order dated 20.7.2018, which has been passed while issuing notice to the defendants/petitioners, till disposal of temporary injunction application.
It is admitted to the petitioners, who are defendants in the aforesaid suit that despite getting notice of the suit, they have not turned up before the trial court as yet.
On a point query made by the court, learned counsel for the petitioners submits that the petitioners are co-sharers and their names are recorded in khatauni. The said fact has yet not been brought to the notice of the trial court.
In the said scenerio, this Court does not find any reason to vary or alter the ex-parte interim injunction order dated 20.7.2018.
It is open for the petitioners to file their objection before the trial court and seek recall/revocation/variation or setting aside the ex-parte interim injunction order dated 20.7.2018, who may do the needful, in accordance with law.
Subject to the above observations and directions, the present petition is disposed of.
