Heard Sri Daya Ram Singh Chauhan, learned counsel for the applicant, Sri Sanjay Singh, learned AGA-I, for the State.
This application has been filed under section 482 Cr.PC with prayer seeking quashing of the order dated 26.6.2019 passed by the IInd Addl. Sessions Judge, Azamgarh and to direct him to provide the opportunity of cross examination in Special Case No. 58 of 2010 (State v. Satya Dev) arising out of Crime No. 292 of 2010, under section 8/20/27 of NDPS Act, Police Station- Kotwali, District- Azamgarh, pending in the court of IInd Addl. Sessions Judge, Azamgarh.
Learned counsel for the applicant has confined his prayer to the extent that the court below be directed to provide opportunity to the applicant for cross examination in the aforesaid case.
Considering the facts and circumstances of the case, the order dated 26.6.2019 passed by the IInd Additional Sessions Judge, Azagarh is hereby set aside and the matter is remitted back to the concerned court below to pass a fresh order after giving opportunity of cross examination to the applicant in the aforesaid case.
With the above directions, present application is disposed of.
