Order in the Civil Application:-
1. It is submitted by learned advocate Mr. Talreja for the applicant that present civil application does not survive now as appearance is filed by respondent no.2. In the Civil Application, present applicant has prayed in para-4(A) and 4(C) that:
"4(A) YOUR LORDSHIPS be pleased to issue fresh Rule to respondent no.2.
4(C) YOUR LORDSHIPS be pleased to permit issue of fresh notices to respondent no.2."
2. The applicant has also prayed in para-4(B) that:
"4(B) YOUR LORDSHIPS be pleased to allow amendment of Cause Title of respondent no.2"
3. In view of fact that learned advocate Mr. Mehta has now entered appearance for all the three respondents, the relief as prayed for by the applicant in the application now does not survive and/or any order in that context would now not be required. Hence, the said Civil Application is disposed of.
