The relief sought in this petition would depend upon the applicability of the provisions of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
The Court has been informed that by an order dated 21.2.2018 passed by the Apex Court in Special Leave to Appeal (C) No.8453 of 2017 (State of Haryana and others vs. M/s G.D. Goenka Tourism Corporation Limited and another), matters concerning interpretation/applicability of Section 24(2) of the Act of 2013, pending in all Courts ought to remain stayed till the issue is resolved by a larger Bench of the Apex Court.
In view of the above, proceedings in this petition are adjourned sine-die, the parties shall be at liberty to move an application as and when the matter is disposed of by the Apex Court or any clarificatory order is obtained in that regard.
