Heard Shri Yogendra Kumar along with Shri Brajesh Kumar Singh, learned counsel for the appellant and learned A.G.A. and perused the record.
This Criminal Misc. Bail Application No. 283474 of 2016 is moved by the appellant Satendra Singh for bail during the trial in G.S.T. No.219 of 2008 (State of U.P. vs. Satendra Singh and others) arising out of Case Crime No. 135 of 2008, under section 2/3 Gangster and Ante Social Activities (Prevention) Act 1986.
As per gang-chart 4 cases are shown pending against the accused-appellant, out of those 4 cases in Crime No. 447 of 2004 and in Crime No. 272 of 2007 accused has already been acquitted and in Crime No. 38 of 2008 and 55 of 2008 accused-appellant was convicted but their bailed out by the High Court in appeal.
Considering these fact, in my opinion, this bail application deserves to be allowed.
Hence, the Criminal Misc. Bail Application No. 283474 of 2016 is allowed.
Let the accused-appellant Satendra Singh be enlarged on bail in G.S.T. No.219 of 2018 (State of U.P. vs. Satendra Singh and another) arising out of Case Crime No. 135 of 2008, under section 2/3 Gangster Act on furnishing the personal bond of Rs. 1,00,000/- and two sureties in the like amount to the satisfaction of the Court concerned during the pendency of this appeal. Provided the appellant deposits the amount of fine in the Court concerned at the time of his release on bail.
Reminder be issued to the Court concerned for sending the lower Court record, expeditiously.
List after one month.
