1. Heard Sri Prabhat Kumar Singh, learned counsel for the petitioner and learned Standing Counsel for the respondents No.1 to 4-State. Notice need not be issued to respondent No.5 at this stage.
2. This writ petition has been filed against order dated 02.09.2021 passed by respondent No.3 suspending the fair price shop license of the petitioner.
3. Learned Standing Counsel at the very outset submitted that against the order passed by respondent No.3, the petitioner has an alternative remedy of filing appeal under Clause 13(3) of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016.
4. In view of the above, writ petition is dismissed on the ground of alternative remedy.
5. However, in case the petitioner approaches the appellate authority within a month from today along with a copy of this order downloaded from the Official Website of High Court, Allahabad, the appellate authority shall not go into the questions of limitation and decide the same strictly in accordance with law.
