Heard learned counsel for the applicant and the learned AGA for the State and perused the record.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the Special Chief Judicial Magistrate, Allahabad to decide the Complaint Case No.1447 of 2016 (Sarita Devi Vs. Vinay Kumar and others), under Sections 498-A, 323, 504, 506 of I.P.C. and Section 3/4 of D.P. Act, P.S. Saray Inayat, District Allahabad expeditiously within stipulated period.
Learned counsel for the applicant has submitted that the present proceeding has been pending since the year 2016 and has been lingering-on, on one pretext or the other.
In view of the above, the court below is directed to make all endeavours to decide the aforesaid complaint case as expeditiously as possible, preferably within a period of one year from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the application u/s 482 Cr.P.C. is finally disposed of.
