Heard learned counsel for the applicant, Sri Ramkailash Rajbhar, learned counsel for the informant and learned AGA for the State and perused the material placed on record.
The present bail application has been filed by the applicant to release him on bail in Case Crime No. 205 of 2020, under Sections 307, 504 I.P.C. and 3/25/27 Arms Act, Police Station Ahraula, District Azamgarh.
It is submitted by the learned counsel for the applicant that the applicant has been falsely implicated in the present case. It is further submitted that no specific role has been assigned to the applicant. It is next submitted that the injuries received by injured are not on vital part and not grievous in nature. It is next submitted that applicant is languishing in jail since 16.12.2020. The applicant has no criminal history, therefore, he may be released on bail.
Learned A.G.A. as well as learned counsel for the informant has opposed the prayer for bail and submitted that the applicant has been assigned the role of single firing causing grievous injury, which is also getting full support from the injury report as well as statement of the injured recorded by the police, therefore, applicant is not entitled for bail.
I have considered the submissions advanced by learned counsel for the parties. No case for bail is made out. The bail application is accordingly rejected.
However, the trial court is directed to expedite the trial and conclude the same as expeditiously as possible, preferably within a period of nine months without granting unnecessary adjournment to either of the parties.
