Heard learned counsel for the applicant and learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 0239 of 2020, under Sections 364A, 120B I.P.C., Police Station Iglas, District Aligarh.
It is contended by learned counsel for the applicant that the applicant is innocent and has falsely been implicated in the present case. He was not named in the FIR and his name surfaced in the confessional statement of Vinod. Alleged recovery of Rs. 10,000/- is frivolous. Applicant has criminal history of certain cases, which is explained in the affidavit.
Per contra, learned A.G.A. has vehemently opposed the bail application and informed that applicant is having criminal history of 19 cases and he is a habitual criminal. Therefore, no case is made out for granting bail.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
The trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of one year from the date of production of certified copy of this order.
