It is alleged that petitioner has been continuing as Sweeper in the office of District Treasury Officer, Etawah since 1998.
The grievance of the petitioner is that his services have not been regularized. Reliance is placed upon Regularization Rules notified on 24th February, 2016 whereby persons engaged on daily wage post/ work charged/ contract are liable to be considered for regularization. Learned counsel for the petitioner has also produced before the Court a communication sent by the Senior Treasury Officer, Etawah dated 27th of April, 2016 whereby petitioner's claim has also been forwarded for being considered for regularization. It is submitted that only because of pendency of the present writ petition, the authorities have not considered petitioner's claim for regularization so far.
Learned Standing Counsel states that competent authority shall examine petitioner's grievance in accordance with law.
In the facts and circumstances noted above, this petition stands disposed of with a direction upon respondent no. 3 to accord consideration to petitioner's claim for regularization, keeping in view the proposal forwarded by respondent no. 4 to him on 27th of April, 2016. The petitioner's claim for regularization would be examined in accordance with the Regularization Rules notified on 24th February, 2016 and appropriate decision will be taken within a period of three months from the date of presentation of certified copy of this order.
