Heard Shri Ranjeet Asthana, learned counsel for the petitioner; Shri P.K. Chauhan, learned Standing Counsel for the State respondent nos.1 and 2 and Shri Diwakar Singh, learned counsel for the Gaon Sabha.
The petitioner is before this Court with request to issue direction to the second respondent, Sub Divisional Magistrate, Chail, District Kaushambi to issue allotment letter of fair price shop in question in his favour. The request has also been made for issuing direction to the third respondent, Superintendent of Police, District Kaushambi to issue character certificate in his favour.
Learned counsel for the petitioner very fairly states that the petitioner is not pressing the second relief and the first relief may be accorded to him.
Learned counsel for the respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to proceed in the matter and decide the claim set up by the petitioner strictly in accordance with law within a period of two months from the date of production of a certified copy of this order before him.
