Heard learned counsel for the petitioner, Sri Arun Kumar, learned counsel who appears for the Basic Education Officer and Sri Pankaj Kumar Rai, learned Standing Counsel for the State respondents.
The contractual engagement of the petitioner has been ended by means of the impugned order of 18 September 2020. It is the quashing of this order which is sought by means of the present writ petition. It is not disputed before the Court that the services of the petitioner are governed solely by the contract and the terms and conditions of service are not controlled by any statutory rules or regulations. In view of the aforesaid, it is manifest that the relief of quashing of the impugned order which would essentially require the Court framing an appropriate direction for reinstatement cannot possibly be granted. The Court bears in mind the judgment rendered by the Division Bench of the Court in Rajesh Bhardwaj Vs. Union of India [2019 (2) ADJ 830] in this context.
Consequently, the writ petition fails and is dismissed.
