Heard Sri Ashok Shukla, learned counsel for the petitioner.
Notices for opposite parties have been accepted by Sri Shishir Jain, learned counsel, who has put in appearance on their behalf.
By means of this writ petition, the petitioner has assailed the charge-sheet dated 25.10.2016 approved on 15.11.2016 as well as of O.M. dated 28.03.2017, as contained in Annexure Nos.2 and 4 respectively to the writ petition.
The main ground for assailing the aforesaid charge-sheet and order is that there is no provision in the department to proceed against the retired employee and the petitioner has already retired from service on 31.05.2017. Therefore, learned counsel for the petitioner has submitted that the aforesaid charge-sheet and O.M. dated 28.03.2017 may be set aside and the authority concerned may be directed to pay all post retiral benefits to the petitioner with expedition.
Sri Shishir Jain, learned counsel appearing for the opposite parties prays for and is granted four weeks' time to seek instructions in the matter.
