Heard learned counsel for the petitioner and Shri Vivek Srivastava, learned Standing Counsel. Shri Manoj Kumar Yadav has accepted notice on behalf of respondent no.5.
The petitioner is before this Court for a direction to Addl. Collector (Finance and Revenue) Ghazipur to decide Case No.163 of 1989 under Section 198 (4) of UPZA & LR Act (Sant Lal v. Mani Ram) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to the Addl. Collector (Finance and Revenue), Ghazipur to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
