|

JUDGMENT / ORDER

Court No. - 21
Case :- WRIT - C No. - 24075 of 2019 Petitioner :- M/S Sansar Infratech Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rahul Sahai Counsel for Respondent :- C.S.C.,Anuj Pratap Singh
Hon'ble Pradeep Kumar Singh Baghel,J. Hon'ble Piyush Agrawal,J.
The petitioner has preferred this writ petition for a direction upon the respondents to sanction its map.
The grievance of the petitioner is that commercial plot no. R-1, area 10568.25 square meter, 1-A Tala Nagri Housing Sector 1st, Aligarh was allotted to it by respondent no. 2 in pursuance of advertisement dated 3.11.2016. A copy of the allotment order dated 3.1.2017 is on the record.
It is stated that the petitioner has submitted an application for the sanction of map but no action has been taken by the respondents.
We have heard learned counsel for the petitioner, learned Standing Counsel and Sri Swapnil Kumar, learned Advocate appearing for respondent nos. 2, 3 & 4.
Having due regard to the facts of the case, we are of the view that ends of justice would be subserved by issuing a direction upon respondent no. 3 to consider the cause of the petitioner and pass appropriate order on his application for sanctioning the map in accordance with law expeditiously, preferably within two months from the date of communication of this order.
Needless to say that we have not considered the issue on merits, the authority concerned shall pass the order independently and in accordance with law.
The writ petition is, accordingly, disposed of. No order as to costs.
Order Date :- 25.7.2019 Digamber
