Heard Sri Gopal Ji Khare, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner has prayed for a mandamus upon the tribunal to decide the election petition filed in the year 2021 within a stipulated period of time.
At this stage, no good cause for prioritising the hearing of an election petition filed in the year 2021 over other matters pending before the court below is made out before this Court.
Faced with this, counsel for the petitioner does not press the relief sought in the writ petition and recasts the relief. He prays for grant of liberty to approach the learned tribunal.
It is open to the petitioner to move an application for expediting the hearing of the election petition before the election tribunal. In case such application is moved, the same shall be decided by the election tribunal in accordance with law and as per its roster.
The writ petition is disposed of.
