The instant writ petition has been filed by the petitioner challenging the possession notice dated 11.10.2021 issued by the respondent-Bank under Section 13(4) of the Securitisation and Reconstruction of Assets and Enforcement of Security Interest Act, 2002.
Learned counsel for the petitioner has not disputed the correctness of the amount mentioned in the impugned notice. The only submission is that on account of COVID-19 pandemic, the petitioner has suffered huge loss and therefore, he may be permitted to pay the outstanding amount in installments spread over a period of six months.
Sri Sandeep Kumar Singh, learned counsel for the respondent- Bank has accepted the offer.
Accordingly, the instant writ petition is disposed of as follows:
a) the petitioner will deposit 25% of the amount mentioned in the impugned notice within 30 days from today.
b) the remaining amount shall be deposited by the petitioner in two monthly installments i.e. by the end of February, 2022 and April, 2022.
In case of default in payment of amount, as stipulated above, the instant order shall stand automatically discharged and it shall be open to the respondent-Bank to proceed further in the matter.
