Vakalatnama has been filed by Sri Ashok Kumar Singh, Advocate on behalf of the complainant, is taken on record.
Heard Sri Sanjay Vikram Singh, learned counsel for the applicants, Sri Ashok Kumar Singh, learned counsel for the complainant, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the complainant that the case is of the year 2010 and the applicants had earlier approached this Court on several occasions challenging the charge sheet as well as order of discharge and non bailable warrant against which he has also preferred some petitions before the Apex Court and which found reference in the order passed by co-ordinate Bench in Criminal Misc. Application No.35891 of 2018 in the case of Girdhari Yadav Vs. State of U.P. and another which was dismissed lastly on 17.07.2019. A copy of the same has been annexed as Annexure 7 to the writ petition.
Learned counsel for the applicants do not dispute the aforesaid facts.
In view of the above, I am not inclined to interfere in the said application.
Without expressing any opinion on the merits of the case and considering the submissions advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicants, namely, Sanjesh Singh, Dinesh Babu, Charan Singh, Rajbeer Singh and Satya Pal Singh involved in Case Crime No.209 of 2010, under Sections 395, 397 I.P.C., Police Station Mungra Badshahpur, District Jaunpur.
Accordingly, the anticipatory bail application is rejected.
However, the applicants are at liberty to move bail application u/s 439 Cr.P.C., if so advised.
