Heard learned counsel for the revisionists, learned A.G.A. and perused the record.
The present criminal revision has been filed against the order dated 10.01.2020 passed by learned Sessions Judge, Bulandshahr in Session Trial No.150 of 2019 (State vs. Sanjay and others) arising out of Case Crime No.683 of 2017, under sections 452, 323, 504, 506, 308, 325 I.P.C., Police Station- Khurja Nagar, District- Bulandshahr an well as the discharge application dated 20.09.2019 which has been rejected by the court below.
From perusal of the impugned order it transpires that section 308 I.P.C. is not made out which is already stated in the impugned order but in the operative part it is only stated that discharge application is dismissed.
The court below to mention whether the section 308 I.P.C. is made out or not.
With these observations the impugned order is quashed and the revision is partly allowed and matter is remanded back to the court below to pass appropriate orders in the interest of justice within a period of two weeks in accordance with law.
