Heard Sri Sudhanshu Pandey, learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for issuing direction to Additional Chief Metropolitan Magistrate- 1st, Kanpur Nagar, District Kanpur Nagar, to expeditiously decide the Complaint Case No. 11035 of 2018 (Sanjay Sharma vs. Smt. Rekha and others), under sections 323, 504, 506 I.P.C., Police Station Naubasta, District Kanpur Nagar pending before Additional Chief Metropolitan Magistrate-1st, Kanpur Nagar within three months.
Learned counsel for the applicant submits that the applicant filed complaint case on 23.02.2018 for summoning the accused persons for offence under sections 323, 504, 506 I.P.C. for the criminal incident dated 11.02.2018 but despite lapse of over six months, only statement of applicant/complainant has been recorded and statement of his witnesses under section 202 Cr.P.C. have not been recorded as yet.
Upon hearing learned counsel and perusal of record, the application U/S 482 Cr.P.C. is disposed of with the direction to the trial court for expeditious disposal of the complaint case in accordance with procedure laid down under Chapter-XV of Cr.P.C., if possible, within three months from the date of presentation of copy of order before it.
