Heard learned counsel for the petitioner and learned Standing Counsel for the State respondent.
Learned counsel for the petitioner submits that the controversy involved in the present matter is squarely covered by the judgement and order of this Court dated 22nd July, 2021 passed in Writ A No. 3925 of 2021. It is argued that this case may also be directed to be considered in the light of judgment passed by this court.
Learned Standing Counsel has no objection to the same.
In view of above, writ petition is disposed of in terms of the order passed in Writ-A No. 3925 of 2021 dated 22nd July, 2021. The order impugned dated 6.7.2020 passed by the third respondent is set aside. The matter is remitted to respondent no. 3, District Basic Education Officer Deoria to decide it afresh strictly in accordance with law and in the light of order passed in Writ-A No. 3925 of 2021 dated 22nd July, 2021 but certainly after affording opportunity to all stakeholders in the matter. The said exercise is to be completed within three months from the date of production of a copy of this order.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
