Heard learned counsel for the applicant and learned A.G.A. for the The present application has been filed for quashing the order dated 16.5.2019 passed by Addl. District Judge/Fast Track Court No.1, Aligarh in ST No.473/2015 State vs. Sanjay Kumar under Sections 498A, 302 IPC and ¾ DP Act PS Gabhana District Aligarh arising out of case crime no.139/2015.
Contention of the learned counsel for the applicant is to the effect that the applicant had filed an application on 4.4.2019 before the learned trial court to adjourn the cross examination of PW-1 and PW-2 namely Raj Kumar Sharma and Dharmendra. However, this application has been rejected vide order dated 16.5.2019 which is under challenge in the present application.
Perusal of the impugned order dated 16.5.2019 shows that the repeated opportunity was given by the court concerned to PW-1 Raj Kumar Sharma and PW-2 Dharmendra for their cross examination but in spite of the same, the said witnesses had not appeared before the court concerned and their cross examination could not be done and thus, the court concerned had closed the opportunity for cross examination of PW-1 and PW-2 as far back in the year 2017 and 2018 respectively. The court concerned while passing the impugned order has clearly observed that the application to adjourn the cross examination of PW-1 and PW-2 has been filed in the year 2019 just to linger on the proceedings. After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the order impugned as well averments made in the present application, this Court is of the opinion that learned counsel for the applicant could not point out any illegality or perversity in the order impugned which may warrant any interference by this Court.
Accordingly, the application u/s 482 CrPC lacks merit and is dismissed.
