Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 and 2 and Sri S.C. Dwivedi, learned counsel for respondent no.3.
This writ petition has been filed by the petitioner with the following prayer :-
"a) A writ, order or direction in the nature of MANDAMUS directing the respondent no.2 and 3 to provide compensation of the acquired land of the petitioner in the new rate according to law bearing Arazi no.634 area 0.1540 situated Mauja Bairi Akbarpur Kachchar Tehsil Kanpur Sadar and District Kanpur Nagar or direct the respondent no.3 to the return the land of the petitioner forthwith,
b) Issue any other order or direction as this Hon'ble Court may deem fit and proper under the circumstances of the case.
c) Award the cost the petition in favour of the petitioners."
When this matter has been taken up today, Sri S.C. Dwivedi has informed the Court that the award in respect of the petitioner's land was passed by Special Land Acquisition Officer, Kanpur Nagar, on 9.12.2010, but the petitioner has not come forward to claim the awarded amount of compensation.
In view of the statement made by Sri S.C. Dwivedi, we dispose of the writ petition with liberty to the petitioner to move an application before the Special Land Acquisition Officer, with the prayer to release the amount of compensation in his favour in terms of award dated 9.12.2010 in respect of his acquired plot.
