Heard Shri Jitendra Yadav, learned counsel for the petitioners, learned A.G.A. for the opposite party Nos. 1 to 5, Shri Shivbaboo, learned counsel for the opposite party Nos. 7 & 8 and Shri Praveen Kumar Tripathi, learned counsel for the opposite party Nos. 9 to 11.
Present Habeas Corpus Writ Petition has been filed by the father of petitioner No. 1 for direction to the respondent No. 3 to produce the petitioner No. 1, Sanjana (corpus) before this Court.
In compliance of the order of this Court dated 25.11.2021, corpus Sanjana has been produced before this Court by S.I. Hari Shyam Singh Chandel, PNO No. 822031334 and Constable Sushmita Yadav, PNO No. 182441530.
Corpus Sanjana stated before this Court that she is major. She is living with her friend (Saheli) on her own sweet and free will. She is not in the illegal detention of respondent Nos. 6 to 11.
It is undisputed fact that the corpus is major as majority of the corpus has not been questioned. As the corpus is major and she has stated before this Court that she is living with her friend, therefore, corpus Sanjana is free to go to live wherever she wishes.
In view of the statement made by the corpus, the present Habeas Corpus Writ Petition is dismissed.
