Sandhya, petitioner-1 appears before the Court. She states that she voluntarily married to Prem Das, petitioner-2. In the FIR also age of Sandhya, petitioner-1 has been mentioned as 18 years, which shows that she is major.
Counsel for the petitioners states that petitioner-1 has voluntarily married to petitioner-2 and they are major, therefore, no offence is made out under Section 366 and 120 B IPC.
In the facts of the case, the writ petition is disposed of with direction that petitioners shall not be arrested in pursuance of FIR dated 14.7.2018 registered as Case Crime No. 0598 of 2018, under Section 366 and 120 B IPC, P.S. Kotwali Chhibramau, Distt. Kannauj, till submission of police report under Section 173 (2) Cr P C.
