Heard learned counsel for the petitioner; learned AGA for the respondent nos. 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 30.12.2018 registered as Case Crime No. 0432 of 2018, under Sections 279, 304-A IPC, Police Station Rabupura, District Gautam Budh Nagar.
The allegation in the first information report relates to causing accident by rash and negligent driving, resulting in death of the informant's brother.
As the allegation discloses commission of cognizable offence, the prayer of the petitioner to quash the first information report cannot be accepted.
The petition is dismissed. The petitioner is at liberty to apply for bail.
