Heard Sri Santosh Kumar Chaubey, learned counsel for the petitioner and learned Standing Counsel for respondents.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus commanding and directing the Tehsildar, Tehsil Saidpur, District Ghazipur, i.e. respondent no.2, to decide the mutation proceeding bearing Case No.03476 of 2019, bearing Computerized No.T.201914290403476, (Sandeep Kumar Jaiswal Vs. Laxman Prasad), pending under section 34/35 of Uttar Pradesh Revenue Code-2006, within stipulated period of 2 months."
It is contended by counsel for the petitioner that proceedings under Section 34/35 of U.P. Revenue Code, 2006 is pending consideration since 2019. The sole prayer is for early disposal of the aforesaid proceedings.
Learned Standing Counsel has pointed out that a transfer application is pending in the said matter as it appears from the perusal of order-sheet of the case.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 2 to conclude the proceedings of aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
