Heard learned counsel for the petitioners and learned Sanding Counsel.
The petitioners, by means of the present writ petition, have assailed the order dated 22.09.2005 issued by respondent no.8 for allocation of petitioners from State of Uttar Pradesh to the State of Uttranchal.
Learned counsel for the petitioners has brought to the notice of this Court about the judgement of this Court dated 22.05.015 passed in Writ-A No.3636 of 2005 (Jagdish Narayan Doharey Vs. State of U.P. and Others) and contends that the controversy in hand is squarely covered by said judgement of this Court.
Learned Standing Counsel does not dispute the fact that the controversy in hand is squarely covered by the judgement of this Court passed in the aforesaid writ petition.
Accordingly, the impugned order dated 22.09.2005 issued by respondent no.8 for allocation of petitioners from State of Uttar Pradesh to the State of Uttranchal, is set aside.The writ petition is allowed in terms of the judgement of this Court dated 22.05.2015 passed in Writ-A No.3636 of 2005 (Jagdish Narayan Doharey Vs. State of U.P. and Others).
