Samuben vs Natvarlal

High Court Of Gujarat|03 July, 2012

JUDGMENT / ORDER

Mr.Vakil, learned advocate for the petitioners does not press this petition at this stage with a liberty to approach the Gujarat Revenue Tribunal for filing an appropriate application for being joined as party on the basis of averments, which are made in the present petition.
It goes without saying that if any such application filed by the present petitioners, the same shall be dealt with by the Tribunal in accordance with law after giving opportunity of being heard to all the parties. It is also made clear that this court has not opined anything on merits of the matter and the Tribunal shall decide the said application, if any, filed by the petitioners uninfluenced by the fact that the instant application was filed and subsequently it was not pressed.
With these observations, the application stands disposed of, as not pressed. Direct service is permitted.
