This petition has been filed to direct the learned Additional District and Sessions Judge / Fast Track Court No. 2, Ghaziabad to implement the order dated 10.5.2012 passed by the Additional Civil Judged (J.D) / A.C.J.M., Ghaziabad in Case No. 354 of 2010 (Smt. Samsheeda & Another vs. Yusuf), under Section 125 Cr.P.C., Police Station Niwadi, District Ghaziabad.
Heard learned counsel for the parties.
Learned counsel for the applicants has submitted that the applicant no. 1 and 2 are the the wife and daughter of opposite party no. 2 respectively. A maintainance of Rs. 3,000/- per month in favour of applicant no. 1 and Rs. 3,000/- per month in favour of applicant no. 2 was granted vide order dated 10.5.2012 by the Additional Civil Judge, Senior Division, Court No. 7, Ghaziabad but a single penny has not been paid by the opposite party no. 2. Execution Application Nos. 29 of 2015, 37 of 2016, 55 of 2017 and 242 of 2018 (Smt. Samsheeda and Another vs. Yusuf) have also been filed but learned lower court has not decided the same, as such, prayer has been made that a direction may be given to expeditious disposal of the petition.
Looking in to the facts and circumstances of the case, it will be appropriate that a direction for expeditious disposal of the above mentioned case is given.
This application under Section 482 Cr.P.C. stands allowed.
Additional District and Sessions Judge / F.T.C. Court no. 2, Ghaziabad is directed to dispose of the execution applications filed on behalf of the applicants within a period of six months.
