The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 03.08.2011 and 11.08.2011 passed in Writ Petition No.43350 of 2011. The operative portion of the order is reproduced hereinbelow :-
"In view of the aforesaid, this petition is disposed of with a direction that in the event the petitioner files a representation along with the certified copy of this order within two weeks from today before the Executive Officer, Rajapur, District Chitrakoot, an appropriate order shall be passed by the Executive Officer expeditiously, preferably within a period of three months from the date of filing of the representation."
An affidavit of compliance was filed by the opposite party. It is stated in para 3 of the affidavit of compliance that in pursuance of the order passed by this Court, pension has been released in favour of the applicant i.e. a sum of Rs.18,323/- on 01.12.2011 by means of cheque no.145490, Banda District Cooperative Bank Ltd. Banda Branch-Rajapur dated 01.12.2011.
Since order has been complied with therefore, no cause of action remained survive.
Acordingly, the present contempt application is dismissed. However, in case applicant is still aggrieved, he is permitted to file a fresh representation along with the copy of this order within four weeks from today before the appropriate authority. The appropriate authority is directed to consider and decide the same expeditiously and preferably within a period of four months from the date of receipt of representation.
