JUDGMENT / ORDER

Court No. - 9
Case :- WRIT - C No. - 19084 of 2019 Petitioner :- Samodhan Respondent :- Up Ziladhikari And 18 Others Counsel for Petitioner :- Chandra Bhan Yadav Counsel for Respondent :- C.S.C.,Ramesh Chandra Upadhyay
Hon'ble Anjani Kumar Mishra,J.
Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) Issue a writ, order or direction in the nature of Mandamus directing the Up Ziladhikari, Nizamabad, District-Azamgarh to decide the Case No. 04380/2018 Computerized Case No.T201815060204380 (Samodhan Vs. Gaon Sabha and others) under Section 24 of U.P. Revenue Code-2006 pending before him finally, within stipulated period of time, if possible within a period of two months."
It is stated that the demarcation proceedings instituted in June 2018 has not been decided finally.
Perusal of the order sheet appended to the writ petition shows that on at least half of the dates fixed in the matter, it has been adjourned on account of lawyers being on strike. It is therefore clear that there is no fault on the part of the court concerned, in case, the matter has not been decided finally.
The writ petition is therefore disposed of with the observation that the court concerned may endeavour to decide the proceedings as expeditiously as possible.
It is however clarified that in case the lawyers continue to remain on strike the respondent no. 1 is not required to comply with the directions contained in this orders.
Order Date :- 30.5.2019 Mayank
