Heard Sri Anuj Bajpai, learned counsel for the petitioner and Sri Ajay Singh Bundela, learned Standing Counsel, appearing for the respondent no.1.
This petition has been filed with the following prayer:
"I. Issue writ, order or direction in the nature of mandamus to direct the respondent No.1/Learned Tehsildar Sadr, District Farrukhabad to decide the Suit No. 00602 of 2018 Samit Singh Vs. Harichand Under Section 34/35 U.P. Revenue Code-2006 expeditiously within stipulated period, which is pending in the court of respondent No.1/Learned Tehsildar Sadar, district Farrukhabad".
The contention of the learned counsel for the petitioner is that the petitioner has filed an application for mutation in 2018 which is pending and same is yet to be decided by the respondent No.1, Tehsildar, Sadar, District Farrukhabad. It is stated that the petitioner is claiming mutation on the basis of a will deed.
Learned Standing Counsel states that the Tehsildar will take a decision within the time specified by this Court.
I have perused and seen the order sheet that has been appended as Annexure-4 to the writ petition. It appears that repeated dates have been fixed and the application is yet to be decided.
Under the circumstances and subject to exclusion of any period of lockdown that may be imposed due to Covid pandemic, the respondent No.1 shall take a decision on the mutation proceeding, expeditiously and preferably within a period of six months from the date, a copy of this order is served upon him.
With the aforesaid observations, this petition is disposed of.
