JUDGMENT / ORDER

Court No. - 37
Case :- WRIT - A No. - 6795 of 2018 Petitioner :- Salma Begum Respondent :- State Of U.P. Thru. Prin. Secy. And 2 Ors.
Counsel for Petitioner :- Rudreshwari Prasad Counsel for Respondent :- C.S.C.
Hon'ble Abhinava Upadhya,J.
Heard Shri Rudreshwari Prasad, learned counsel for the petitioner and learned Standing Counsel appearing for the State-respondents.
The petitioner claims herself to be widow of late Sirazul Haq, who was an employee of respondent no. 3. In the service book it is submitted that the name of the petitioner has been mentioned as nominee. Unfortunately the husband of the petitioner died on 11.8.2017. When the petitioner claimed the terminal dues of her husband, the same is not being extended to her requiring the petitioner to get a declaration that she is his wife.
When the name of the petitioner has already mentioned in the service book as nominee where is the question of seeking a declaration for the said purpose.
The writ petition is disposed of with the direction to respondent no. 2 that in case the petitioner has been shown as nominee in the service book of her husband, her claim be considered and decided in accordance with law, as far as possible, within a period of three months from the date a certified copy of this order is presented before it.
