Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed to quash the charge sheet dated 11.05.2018 in case crime no.90 of 2018, under Sections 269, 290, 291 IPC & Section 3/5/8 Cows Slaughter Act, P.S. Najibabad, District Bijnor, pending before the ACJM, Najibabad, District Bijnor.
Sole prayer which has been pressed by the learned counsel for the applicant in the present application is that the applicant is ready to surrender before the court below. However, he submits that some time may be granted to him to surrender before the court below.
Considering the facts and circumstances of the case, it is provided that in case the applicant surrenders before the court below within 30 days from today and applies for bail, his bail prayer shall be considered and decided in view of the settled law laid by this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
With the aforesaid directions, this application is finally disposed of.
