Considering the provisions of Section 29 of The Protection of Women from Domestic Violence Act, 2005, by which, admittedly an appeal is available against the order passed by the learned Magistrate impugned in this petition and at this stage, upon instruction, learned advocate seeks permission to withdraw with a view to avail the remedy.
If such an application is preferred before the appellate Court, it may be considered in accordance with law as expeditiously as possible keeping in mind that this Court has not entered into the merit of the case.
With the aforesaid, the petition is disposed of as withdrawn.
