Heard learned counsels for the parties.
The contention on behalf of the applicant is that he wants to deposit the maintenance amount but on account of personal difficulty he could not do so and as such warrants have been issued by the court below vide order dated 20.12.2018.
In the meanwhile, further proceedings of Complaint Case No. 06 of 2018, Smt. Saba & Another v. Sakib, under Section 125 Cr.P.C., P.S. Jalesar, district Etah, as well as the order dated 20.12.2018 shall remain stayed provided the applicant deposits the arrears of December 2018 and January 2019 in two equal installments, first falling on 6th February 2019 and the other on 6th March 2019 and shall further continue to pay Rs. 4,000/- per month, in all, as directed on every 10th day of month continuously from February 2019.
However, it is provided that in the event of any default of any of the directions contained herein above, this interim protection granted, shall stand discharge and the court below shall be entitled to proceed in accordance with law.
This application under Section 482 Cr.P.C. stands disposed of accordingly.
