Heard Sri Bhaskar Bhadra, learned counsel for the petitioner and Sri Pranav Ojha, Additional Chief Standing Counsel for the respondents.
The petitioner is aggrieved by the order dated 23.07.2019 by which on account of overloading his permit has been suspended for a period of 6 months.
The aforesaid order suspending the permit is an order passed under Section 86 of the Motor Vehicles Act and as such is appellable under Section 89 of the Act.
In view of the remedy of appeal available to the petitioner, we decline to exercise our discretionary jurisdiction in the matter and the writ petition is dismissed.
