Court No. - 44
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 29806 of 2019 Applicant :- Sajid And Another Opposite Party :- State Of U.P.
Counsel for Applicant :- Shantanu Srivastava Counsel for Opposite Party :- G.A.
Hon'ble Ramesh Sinha,J.
Heard Sri Aishwarya Pratap Singh holding brief of Sri Shantanu Srivastava, learned counsel for the applicants, Sri G.P.Singh, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicants that though the applicants are said to have fled away from the place of occurrence but their names have been disclosed by the co-accused who were arrested on the spot.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the beef as well as tools for cutting the animals were recovered from the spot.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicants-Sajid and Rashid involved in Case Crime No.247 of 2019, under Section 3/5/8 Cow Slaughter Act, Police Station Dhampur, District Bareilly.
Accordingly, the anticipatory bail application is rejected.
