Heard learned counsel for the parties.
Petitioners applied against the 80 posts of Lecturer (Physical Education) under the Scheduled Caste Category. As per notification dated 6 March 2017, the candidates were invited in the ratio of 1:8 to appear before the Commission for verification of their documents and eligibility. The notification further required that the candidates found eligible and having the requisite marks would be invited to face the interview in the ratio 1:3. It is urged that the petitioners were invited for verification of their documents and marks, however, were not invited for interview after sort listing the candidates in the ratio 1:3.
Learned counsel for the Commission on written instructions dated 5 August 2019 submits that the last candidate called for interview under the Scheduled Caste Category had 74 marks, whereas, the petitioners had 69 marks, 65 marks and 66 marks respectively. In view thereof, the petitioners were not found in the zone of consideration.
On being confronted with the marks, learned counsel for the petitioners does not dispute the marks, but prays that the writ petition be dismissed as withdrawn at this stage.
The writ petition is, accordingly, dismissed as withdrawn.
