Heard learned counsel for the petitioner, learned Standing Counsel for the respondents No.1 and 2 and Sri Vibhuti Narain, learned counsel for the respondent No.3.
The petitioner is carrying out trading on the basis of the licence issued by the Krishi Utpadan Mandi Samiti. He has moved an application dated 20.2.2019 for allotment of a shop in the Mandi Samiti and seeks a direction by means of this writ petition that the said application be processed and considered for allotment of the shop.
The Mandi Samiti invites applications through advertisement for allotment of shops. So far no advertisement has been issued by the Mandi Samiti inviting applications for allotment of shops. Therefore, the petitioner at this stage, has no right so that his application may be considered for allotment of the shop.
In view of the above, we are of the opinion that no direction as sought for in the writ petition can be issued. However, as and when applications are invited by the Mandi Samiti the petitioner is free to apply and his application shall be considered and decided in accordance with law.
With the aforesaid observation, the writ petition is dismissed as devoid of merit.
