In re: Civil Misc. Delay Condonation Application No. 33703 of 2016.
There is delay of 120 days in filing the present appeal. Learned counsel for the appellant has filed an application under Section 5 of the Limitation Act for condoning the delay. The appellant has explained the delay in paragraph no. 5 of the affidavit filed in support of delay condonation application. We have perused the paragraphs no. 5 of the affidavit and we are satisfied that the appellant has sufficiently explained the delay. The delay is condoned.
Accordingly, the delay condonation application is allowed. Office is directed to assign the regular number.
